1. Acceptance of Terms

By accessing or using CymbAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

CymbAI is an AI-powered image generation platform that allows users to create high-quality images using artificial intelligence technology.

2. Account Registration

To use CymbAI's image generation features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account
• Not share your account with others

3. Subscription Plans and Credits

3.1 Credit System

CymbAI operates on a credit-based system where each image generation costs one (1) credit. Credits are available through:

• Free Plan: 5 credits per month
• Starter Plan: 40 credits per month
• Professional Plan: 150 credits per month
• Agency Plan: 350 credits per month
• Top-up Packs: One-time credit purchases (Small Pack: 25 credits, Large Pack: 100 credits)

3.2 Credit Policies

• Subscription credits reset monthly on your billing date and do not roll over
• Top-up credits do not expire and remain in your account until used
• Subscription credits are used before top-up credits
• Credits are non-refundable once purchased
• Failed or interrupted image generations will consume one credit

3.3 Billing and Payments

• Subscription fees are billed monthly in advance via Stripe
• All prices are in British Pounds (GBP) unless otherwise stated
• We reserve the right to change pricing with 30 days' notice
• Payment processing is handled securely through Stripe
• You authorize us to charge your payment method for all fees

4. Cancellation and Refunds

4.1 Subscription Cancellation

You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will retain access to your subscription credits until the period ends
• No refunds will be provided for partial billing periods
• Your account will revert to the Free plan after the billing period ends

4.2 Refund Policy

Due to the nature of digital services and the immediate delivery of credits:

• All sales are final and non-refundable
• No refunds for unused credits or partial subscriptions
• Exceptions may be made at our sole discretion for billing errors or technical issues preventing service access

5. Content Usage and Ownership

5.1 Generated Images

Subject to these Terms and your compliance with them:

• You own the images you generate using CymbAI, including full commercial usage rights
• You are responsible for ensuring your prompts and input images do not infringe on third-party rights
• We retain the right to use generated images for service improvement, marketing, and promotional purposes unless otherwise agreed

5.2 Image Storage

• Free Plan: Last 50 images stored
• Starter Plan: Last 50 images stored
• Professional Plan: Last 100 images stored
• Agency Plan: Last 1000 images stored
• Images exceeding your storage limit may be automatically deleted
• We are not responsible for loss of images; users should download and backup important images

5.3 Watermarks and Logos

Users may upload custom logos or watermarks to be incorporated into generated images. You warrant that you own or have the rights to use any uploaded logos/watermarks.

5.4 Use of Images for Events, Print, and Physical Applications

If you intend to use AI-generated images for events, exhibitions, print materials, signage, large-format displays, or any physical application, you acknowledge and agree that:

• Quality Verification: You are solely responsible for verifying that the image resolution, quality, and format are suitable for your intended use, including print size and viewing distance
• Technical Checks: You must perform appropriate technical checks including but not limited to: resolution adequacy (DPI/PPI), colour accuracy and colour space compatibility, file format suitability, and scaling requirements
• Structural Considerations: For images used on physical structures (banners, billboards, building wraps, exhibition stands, etc.), you are responsible for ensuring the image meets all structural, safety, and regulatory requirements
• Professional Review: We strongly recommend having images reviewed by qualified professionals (graphic designers, print specialists, structural engineers where applicable) before use in high-stakes or large-scale applications
• Test Prints: For critical applications, we recommend producing test prints or proofs before full production runs
• No Liability: CymbAI accepts no liability for any losses, damages, costs, or claims arising from the use of generated images in events, print, or physical applications, including but not limited to: printing errors, colour discrepancies, resolution issues, structural failures, regulatory non-compliance, or any other technical or quality issues
• Indemnification: You agree to indemnify and hold CymbAI harmless from any claims arising from your use of generated images in physical or event applications

AI-generated images are provided as digital assets. The conversion and application of these images to physical media or event use cases is entirely at your own risk and discretion.

6. Acceptable Use Policy

You agree NOT to use CymbAI to generate or attempt to generate:

• Content that is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Content containing nudity, pornography, or sexually explicit material
• Content that promotes violence, discrimination, or hatred against individuals or groups
• Content that infringes on intellectual property rights, including copyrights, trademarks, or patents
• Images of real people without their consent, including deepfakes or misleading representations
• Content intended to deceive, defraud, or manipulate others
• Malicious code, viruses, or any harmful software
• Content that violates any applicable laws or regulations

7. Service Availability and Limitations

While we strive to provide consistent service:

• We do not guarantee uninterrupted or error-free service
• Service may be temporarily unavailable for maintenance, upgrades, or technical issues
• We reserve the right to modify, suspend, or discontinue any aspect of the Service
• Generated images are created by AI and may not always meet your expectations
• We do not guarantee specific results or quality of generated images

8. Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or abusive behavior
• Your payment method fails or you have unpaid fees
• We suspect illegal activity or misuse of the Service

Upon termination, your access to the Service and any remaining credits will be forfeited without refund.

9. Intellectual Property

The CymbAI Service, including its software, design, branding, and underlying technology, is owned by CymbAI and protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Remove or modify any proprietary notices or labels
• Use our trademarks, logos, or branding without permission

10. Privacy and Data Protection

Your use of CymbAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

We use Firebase and Google Cloud Platform for data storage and processing, and Stripe for payment processing.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding accuracy, reliability, or availability
• Warranties that the Service will be secure or error-free
• Warranties regarding the quality or suitability of generated images

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Cymba SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Any damages resulting from unauthorized access to or alteration of your data
• Any damages resulting from your use or inability to use the Service

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless CymbAI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of third parties, including intellectual property rights
• Content you generate using the Service

14. Third-Party Services

CymbAI uses third-party services including:

• Google Gemini AI: For image generation
• Firebase/Google Cloud: For authentication, storage, and database services
• Stripe: For payment processing

Your use of these services through CymbAI is subject to their respective terms of service and privacy policies. We are not responsible for third-party services or their policies.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these Terms or your use of the Service shall be resolved through:

• Good faith negotiations between the parties
• If unresolved, binding arbitration or the courts of the United Kingdom

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
